General Terms And Conditions

§1 Validity of the conditions
The deliveries, services and offers from 3d-filamente.ch are carried out exclusively on the basis of these terms and conditions, even if they are not expressly agreed again. When you order the goods or services, these conditions are deemed to have been accepted. The buyer's general purchasing conditions are hereby contradicted. Deviations from these terms and conditions are only effective if we confirm them in writing.

§2 Offer and conclusion of contract
The offers from 3d-filamente.ch in price lists and advertisements are subject to change and non-binding. Orders are only binding for 3d-filamente.ch after written confirmation. Order confirmations will only be created upon express request. The information in our sales documents (drawings, illustrations, dimensions, weights and other services) are only to be understood as guidelines and do not represent a guarantee of properties unless they are expressly stated in writing as binding. If a buyer exceeds his credit limit by placing an order, we are released from our delivery obligation.

§3 Prices
The prices stated in our order confirmation are decisive. These are fixed for stock items at the time of ordering. In the event of delivery bottlenecks or errands, the current price applies on the day of the order. Unless otherwise agreed, the prices are exclusive of transport costs and include VAT.

§4 Delivery and service time
Dates and delivery times are non-binding unless expressly agreed otherwise in writing. The specification of specific delivery times and delivery dates by 3d-filamente.ch is subject to the correct and timely delivery to 3d-filamente.ch by suppliers and manufacturers.

§5 Default of acceptance
If the buyer refuses to accept the delivery items after a grace period has expired or declares that he does not want to accept the goods, 3d-filamente.ch can refuse to fulfill the contract and demand compensation for non-fulfillment. 3d-filamente.ch is entitled to claim either a flat rate of 25% of the agreed purchase price or compensation for the damage actually incurred from the buyer.

§6 Delivery
Visible differences in quantities must be reported to 3d-filamente.ch and the carrier in writing immediately upon receipt of the goods, hidden differences in quantities within 4 days of receipt of the goods. Complaints regarding damage, delay, loss or poor packaging must be reported immediately upon receipt of the goods.

§7 Transfer of risk
The risk passes to the buyer as soon as the shipment has been handed over to the person carrying out the transport. If shipping is delayed or becomes impossible through no fault of our own, the risk is transferred to the buyer upon notification of readiness for shipping. An agreed assumption of transport costs by 3d-filamente.ch in individual cases has no influence on the transfer of risk.

§8 Warranty (Return-in)
The warranty in accordance with the following provisions is 24 months for private end users and 6 months for commercial customers (companies), unless expressly agreed otherwise in writing. For certain products, a manufacturer's warranty of 12 months or less is expressly stated. The warranty period begins on the date of delivery. If processing and/or storage instructions are not followed or changes are made (e.g. drying filament in the oven), any warranty will be void if the defect is attributable to this. Insignificant deviations from the guaranteed properties of the goods do not trigger any warranty rights. Liability for wear caused by filament on hotends (nozzles, etc.), print bed surfaces (films, glass, etc.), gears, belts, etc. is excluded.
Warranty claims against 3d-filamente.ch are only available to the direct buyer and cannot be assigned. 3d-filamente.ch (except ag) has the right to make improvements. Reduction or conversion are excluded.
"Return-in" means that the customer sends the defective product back to us at his own expense, we inspect and/or test it and send it back at our expense, provided there is a material defect.

There is generally no right of return on items with special or promotional prices from the “Sale%” category and this is hereby excluded!

§9 Returns
A return of products by the customer requires the prior consent of 3d-filamente.ch and is carried out at the customer's expense and risk. The products must be returned in their original packaging and accompanied by a detailed description of the error/defect and a return number sent by us. Products that we procure at the customer's request cannot be returned.

§10 Retention of title
The delivered goods remain the property of 3d-filamente.ch until full payment has been made.

§11 Payment
All orders are paid for in advance in the online shop. Delivery is generally not free, i.e. at the buyer's expense by parcel post, freight forwarder or own vehicle, unless expressly agreed otherwise. A payment is only considered to have been made when we have the full amount available.
Orders with failed payment attempts using one of the payment methods (Paypal, Twint, credit cards) will be canceled.

§12 Limitation of liability
Claims for damages arising from impossibility of performance, from breach of contract, from negligence in concluding the contract and from unlawful acts are excluded against us as well as against our vicarious agents or vicarious agents, unless there is intentional or grossly negligent action. Any liability for consequential damages resulting from the use of the products is rejected.

§13 Copyright / Software Warranty
If software is included in the scope of delivery, it is left to the buyer solely for one-off resale or for his own use, i.e. he may neither copy it nor pass it on to others for use. Software is excluded from all warranty provisions on forms. The provisions of the manufacturer's license agreement apply exclusively.

§14 Data protection
3d-filamente.ch is entitled to process the data received about the buyer regarding the business relationship or in connection with it, regardless of whether it comes from the buyer himself or from third parties, in accordance with the Federal Data Protection Act (DSG). Personal customer data is treated confidentially and only passed on to third parties as part of the credit check.
To improve interaction with our visitors, we use a Java script plugin from uptain GmbH (“uptain plugin” https://www.uptain.de). This allows us to analyze your use of the website and improve customer contact (e.g. through a dialog window or a personalized email). For this purpose, we collect information about your usage behavior, i.e. movement of the cursor, length of stay, links clicked and any information provided. The legal basis for processing is our legitimate interest in direct marketing and the provision of our website (Art. 6 Para. 1 lit f GDPR). As a processor, uptain GmbH is strictly bound to our instructions. The information collected will not be passed on to third parties unless we are legally obliged to do so. If the information collected by the uptain plugin contains personal data, it will be deleted immediately after you visit our website.

§15 Place of jurisdiction
Weinfelden is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
